Terms of Service

These terms govern your use of GoHiboo, an online educational practice service operated by Educa Tutoring Inc., 9520 Boulevard de l'Acadie, Suite 225, Montréal, Québec H4N 1L8. By creating an account you agree to them. If you are subscribing on behalf of a tutoring centre, the person accepting these terms confirms they are authorised to bind that business.
1. Who may hold an account
A parent or legal guardian account may be held only by someone 18 or over who is the parent or legal guardian of the children added to it.
Children do not hold their own accounts in the ordinary sense. A child profile is created by the account holder, who receives credentials to hand to the child. The account holder remains responsible for everything done under those credentials.
A tutoring centre account is held by the business, through a named administrator. Tutors are given access by that administrator and may see only the children assigned to their centre.
2. What the service is
GoHiboo generates practice questions aligned with the Québec program and presents them as a structured daily calendar, with progress reporting for the adult responsible.
It is a practice and enrichment tool. It is not a school, it does not deliver instruction toward a credential, and it does not replace the teaching your child receives at school. We make no promise about grades, examination results, or placement.
Content is generated. Before any of it ships, an independent method re-derives the answer to almost every question from its wording alone — a second opinion that shares no code with the generator. A small number of question types sit outside what that method can solve, and those rest on the generator alone.
No generated content is perfect. If you believe a question or explanation is wrong, tell us — there is a report control on the question itself.
3. Subscriptions, terms and renewal
A subscription is bought for a school year and runs to 1 September. If you subscribe part-way through a year you pay a pro-rated amount to the following 1 September.
Subscriptions renew automatically on 1 September at the then-current price for your plan. We will notify you in advance of each renewal, including the amount and the date, and you may cancel at any point before it is charged.
On renewal each child advances one grade and the new year's content opens. You may opt any child out of that advance, in which case they repeat the year's content.
A single module bought on its own is a one-time purchase. It does not renew and does not advance a grade.
Prices are shown inclusive of GST and QST.
4. Cancellation and refunds
You may cancel at any time. Cancellation stops the next renewal; access continues to the end of the period you have already paid for.
Our refund policy is set out separately and forms part of these terms.
Nothing in these terms removes a right you have under the Consumer Protection Act (Québec) or any other law that cannot be contracted out of.
5. Acceptable use
Do not share account credentials outside your household or centre, resell access, or use the service to provide a competing service.
Do not attempt to extract the question bank in bulk, whether by automated means or otherwise.
Do not attempt to reach data belonging to another family, another centre, or another child.
We may suspend an account that is being used in these ways, and will tell the account holder why.
6. Content and ownership
The service, its software, its question generators and its content remain ours. A subscription grants a personal, non-transferable right to use them for the household or centre that bought it, for as long as it is paid for.
Work your child produces — their answers, scores and progress — belongs to you. You may ask for a copy at any time.
7. Availability
We aim to keep the service available continuously but do not guarantee it. We may take it down for maintenance, and will avoid doing so during the hours children typically use it where we can.
If a fault of ours makes the service substantially unusable for an extended period, contact us and we will deal with it fairly.
8. Limits on our liability
To the extent the law allows, our total liability for any claim connected to the service is limited to the amount you paid us in the twelve months before the claim arose.
We are not liable for indirect or consequential loss.
These limits do not apply to anything that cannot be limited by law, including gross negligence or intentional fault.
9. Changes to these terms
We may change these terms. If a change materially affects your rights or what you pay, we will tell you before it takes effect and you will have the opportunity to cancel rather than accept it.
10. Governing law
These terms are governed by the laws of Québec and the laws of Canada that apply there. The courts of the judicial district of Montréal have jurisdiction.
